• "AisleBird" refers to the website, application, and all related services
• "Company" refers to AisleBird, operated by Siamak Kalhor Consulting LLC
• "User" or "You" refers to any person accessing or using AisleBird
• "Service" means the entire AisleBird platform, including features, content, and functionality
• "Content" includes text, images, data, voice recordings, and any other materials on AisleBird

2. License & Use

2.1 Grant of License

Subject to these Terms, we grant you a limited, non-exclusive, non-transferable, revocable license to access and use AisleBird for your personal, non-commercial use.

2.2 Restrictions

You may NOT:

• Reproduce, distribute, or transmit Content without permission
• Use AisleBird for commercial purposes without written consent
• Attempt to reverse-engineer, decompile, or hack the Service
• Interfere with or disrupt the integrity or performance of AisleBird
• Engage in any form of automated access (web scraping, bots)
• Upload viruses, malware, or malicious code
• Harass, threaten, or harm other users
• Use the Service to violate any laws or regulations

3. User Accounts

3.1 Account Creation

To use certain features of AisleBird, you may need to create an account. You agree to:

• Be responsible for all activities under your account

3.2 Account Termination

You retain ownership of any content you upload (shopping lists, preferences). By submitting Content, you grant us a worldwide, royalty-free license to use it for improving AisleBird.

4.3 Restrictions

You may not modify, copy, distribute, transmit, display, perform, reproduce, publish, license, create derivative works from, transfer, or sell any information, software, or services obtained from AisleBird.

5. Disclaimer of Warranties

AisleBird is provided on an "AS-IS" and "AS-AVAILABLE" basis.

We make NO warranties, express or implied, regarding:

• Accuracy or completeness of aisle locations or store information
• Availability or uninterrupted operation of the Service
• Freedom from viruses, malware, or harmful code
• Results obtained from using the Service
• Quality of products or services from retail partners

We disclaim all implied warranties of merchantability, fitness for a particular purpose, and non-infringement.

6. Limitation of Liability

To the fullest extent permitted by law, AisleBird and its owners shall not be liable for:

• Any indirect, incidental, special, consequential, or punitive damages
• Loss of profit, revenue, data, or use
• Errors or inaccuracies in store locations or product information
• Injuries sustained while shopping based on AisleBird guidance
• Actions or inactions of retail partners or third parties

In no event shall our total liability exceed the amount you paid for the Service (if any).

7. Indemnification

You agree to indemnify, defend, and hold harmless AisleBird, its owners, employees, and agents from any claims, damages, losses, or expenses (including attorney fees) arising from:

• Your use of the Service
• Your violation of these Terms
• Your violation of any laws or regulations
• Your infringement of third-party intellectual property rights
• Content you upload or submit

8. Third-Party Links & Content

AisleBird may contain links to third-party websites and services. We do not endorse, control, or assume responsibility for third-party content. Your use of third-party services is subject to their terms and policies.

9. User Conduct

You agree NOT to:

• Post false, misleading, or defamatory content
• Harass, abuse, or threaten other users
• Spam or flood the Service with repetitive messages
• Engage in illegal activity
• Impersonate another person or entity
• Violate any laws or regulations

We reserve the right to remove any content and suspend accounts that violate these standards.

10. Assumption of Risk

Using AisleBird to navigate retail stores is done at your own risk.

You assume all responsibility for:

• Injuries sustained while shopping
• Reliance on aisle locations that may have changed
• Store closures or modified layouts
• Product availability or pricing

AisleBird is a guide, not a guarantee. Always verify information with store staff before shopping.

11. Modifications to the Service

We reserve the right to modify, suspend, or discontinue AisleBird at any time with or without notice. We are not liable if modifications affect your use of the Service.

12. Termination

We may terminate or suspend your account and access to AisleBird at any time, without notice or liability, if you violate these Terms or engage in prohibited conduct.

Upon termination, your right to use the Service ceases immediately. We may retain your data as required by law.

13. Governing Law & Jurisdiction

These Terms are governed by the laws of the State of California, without regard to conflict of law principles.

Jurisdiction: You agree that any legal action or proceeding related to these Terms shall be filed exclusively in the state or federal courts located in California. You waive any objection to venue or inconvenient forum.

14. Dispute Resolution

14.1 Informal Resolution

Before pursuing legal action, we encourage you to contact us at support@aislebird.com to informally resolve any disputes.

14.2 Binding Arbitration

Any dispute arising from these Terms shall be resolved by binding arbitration in California, except for claims involving intellectual property or emergency injunctive relief.

15. Severability

If any provision of these Terms is found to be invalid or unenforceable, that provision shall be severed, and the remaining provisions shall continue in full force and effect.

16. Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and AisleBird regarding your use of the Service. All prior or contemporaneous agreements are superseded.

17. Amendments

We may modify these Terms at any time. Changes become effective immediately upon posting. Your continued use of AisleBird after modifications constitutes acceptance of the updated Terms.

We will notify you of material changes via email or prominent notice on the Service.
